END-USER LICENSE AGREEMENT
This copy of EULA (“CyberSafeFamily”) and accompanying documentation is licensed and not sold. This Software Product is protected by copyright laws and treaties and laws and treaties related to other forms of intellectual property: TelCloud Services LLC or its affiliates own intellectual property rights in the Software Product. The Licensee’s (“you” or “your” or “User”) license to download and use the Software Product is subject to these rights and all the terms and conditions of this End User License Agreement (“Agreement”). The laws of the United States of America will punish any copyright violations.
Acceptance
YOU ACCEPT AND AGREE TO BE BOUND BY ALL THE TERMS AND CONDITIONS, PRIVACY POLICIES, AND TERMS OF THIS AGREEMENT BY SELECTING THE “ACCEPT” OPTION AND DOWNLOADING THE SOFTWARE PRODUCT OR BY INSTALLING, USING, OR COPYING THE SOFTWARE PRODUCT. YOU MUST AGREE TO ALL OF THE TERMS OF THIS AGREEMENT BEFORE YOU WILL BE ALLOWED TO DOWNLOAD THE SOFTWARE PRODUCT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MUST SELECT “DECLINE,” AND YOU MUST NOT INSTALL, USE, OR COPY THE SOFTWARE PRODUCT.
The licensee needs to understand the CyberSafeFamily privacy policy and how we collect personal data and protect and treat it. CyberSafeFamily takes uttermost care to protect privacy when you are using our software. CyberSafeFamily uses such data in accordance with our privacy policy. CyberSafeFamily expects you to agree to be bound by the privacy policy or privacy notice published on websites and all other privacy notices published by
CyberSafeFamily. By accessing, downloading, or using applications and software.

License Grant
This Agreement entitles you to install the devices based on the number of licenses you paid and purchased. This Agreement does not permit the installation or use of multiple copies of the Software Product or the installation of the Software Product on more than one device at any given time, on a system that allows shared use of applications, on a multi-user network, or on any configuration or system of computers that allows multiple users. Multiple copy use or installation is only allowed if you obtain an appropriate licensing agreement for each user and each copy of the Software Product. Data Collection:
The parents’ first and last names, phone numbers, and email addresses are collected during the registration process and are solely used for authentication and for MFA purposes. This collected data will not be provided or sold to any third party.
CyberSafeFamily App is designed to help parents guide their children in managing their screen time. The following personal data from MDM (in case we are using MDM) will be collected:
The UDID (Unique Device Identifier) used the only purpose is to identify a device for mapping a parent’s setting to a specific device to ensure MDM commands are sent to the correct destination. Device OS version, build version, power utilization, supervision status, device name, device make, model code, and product name are used in the descriptive text to help parents identify devices paired to their account. In addition, it is used by our support team to help resolve user issues.
Application Installations and their selection: This data enables parents to see what the child has installed and select appropriate Apps that the child should be allowed to use.
Collected data will be restricted to only parent/s and for the proper functioning of the App. The CyberSafeFamily will not collect any data from the children directly. Instead, the parents will be provided needed data about the child/children for the proper function of the application. If further protect child data, we encourage the parents to use nicknames rather than real names. We do not direct our services towards children, and we don’t retain any personal information after accounts are canceled longer than we are legally required to. Mobile Device Management (MDM) software is designed to monitor and control devices used by children of all ages: we seek consent from parents to collect and use your child’s data to provide our service before and during your active account.
The data in motion will be secured by HTPPS and SSL. The data will be stored by reputed and secured cloud providers. CyberSafeFamily treats personal data with care and maintains confidentially. We do not share, sell, rent, or trade personal data with third parties for any promotional purposes or any other reasons.
Version 33 of Google Play’s Target API Level Policy is implemented.
Location Service
CyberSafeFamily App collects children’s location data exclusively for parents’ consumption to provide location services like geo-fencing, driving safely, and current location data. Location data is secured by HTPPS and SSL in motion and encrypted when stored.
Call log Data Collection:
Why do we collect call log data?
To provide call monitoring and call blocking service, the CybersafeFamily App implements the READ_CALL_LOG function, which allows the app to read the user’s call logs on the child’s device. By using our call monitoring and blocking service, you understand and grant permission and agree that the service, by its nature, collects call logs and other related data from the child’s device (call history – contact name, number, time of call). This data will be used solely for parents or legal guardians who may see this information for monitoring and blocking purposes.
How do we treat and process the collected data?
While the cyber threats are real, we protect collected data to the best of our ability. The data in motion will be secured by HTPPS and SSL. The data will be stored by reputed and secured cloud providers. CyberSafeFamily treats personal data with care and maintains confidentially. We do not share, sell, rent, or trade personal data with third parties for promotional purposes or other reasons.
By accepting our privacy policy, you are granting us permission to collect the call logs and other related data.
Restrictions on Transfer
Without first obtaining the express written consent of CyberSafeFamily, you may not assign your rights and obligations under this Agreement or redistribute, encumber, sell, rent, lease, sublicense or otherwise transfer your rights to the Software Product.
Restrictions on Feature
while the CyberSafeFamily app is trying to provide all the functionality on most computing and mobile devices, in some cases, due to restrictions imposed by the device manufacturer, some functions will not work entirely or will not work at all.
Restrictions on Use
This application (App) is restricted only to the legal parent/s or legal guardian/s of the child/children who legitimately purchased and downloaded the app. The local laws will severally punish any breach of this agreement.
You may not use, copy, or install the Software Product or App on any system that does not have a valid license purchased and paid for and the devices that do not belong to your household.
You may not decompile, “reverse-engineer,” disassemble or otherwise attempt to derive the source code for the Software Product/App.
You may not use the database portion of the Software Product in connection with any software other than the Software Product.
Restrictions on Alteration
You may not modify the Software Product or create any derivative work of the Software Product or its accompanying documentation. Derivative works include but are not limited to translations. You may not alter any files or libraries in any portion of the Software Product. You may not reproduce the database portion or create any tables or reports relating to the database portion.
Restrictions on Copying
You may not copy any part of the Software Product except to the extent that licensed use inherently demands the creation of a temporary copy stored in computer memory and not permanently affixed to the storage medium.
Installation
The Licensee must be the primary user of the device on which the Licensed Software is installed. This Agreement shall apply to all installations of the Licensed Software. Licensee may only install the permissible copies of the software according to the license purchases and paid.
Termination of Services
As part of the payment terms, the user is responsible for making payments promptly. The user will be charged their credit card on the due date if the user is unable to meet the commitment of agreed payment terms. The services will be terminated without any notification.
Indemnification
Licensee will indemnify and hold licensor harmless from all claims, losses, data losses, liabilities, damages, fines, penalties, costs, and expenses (including attorney’s fees) arising from or relating to licensee’s illegal or improper uses of the licensed software from any third party. Licensee’s obligations under the section shall survive the expiration or termination of this agreement.
Limited Software Product Warranty
For a period of 30 days from the date of shipment or from the date that you download the Software Product, as applicable, warrants that the Software Product will perform substantially as advertised when properly installed and used under normal conditions.
Disclaimer of Warranties and Limitation of Liability
UNLESS OTHERWISE EXPLICITLY AGREED TO IN WRITING BY CyberSafeFamily MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, IN FACT, OR IN LAW, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OTHER THAN AS outlined in THIS AGREEMENT OR IN THE LIMITED WARRANTY DOCUMENTS PROVIDED WITH THE SOFTWARE PRODUCT.
CyberSafeFamily makes no warranty that the Software Product will meet your requirements or operate under your specific conditions of use. CyberSafeFamily makes no warranty that the operation of the Software Product will be secure, error-free, or free from interruption. YOU MUST DETERMINE WHETHER THE SOFTWARE PRODUCT SUFFICIENTLY MEETS YOUR REQUIREMENTS FOR SECURITY AND UNINTERRUPTABILITY. YOU BEAR SOLE RESPONSIBILITY AND ALL LIABILITY FOR ANY LOSS INCURRED DUE TO THE FAILURE OF THE SOFTWARE PRODUCT TO MEET YOUR REQUIREMENTS. CyberSafeFamily WILL NOT, UNDER ANY CIRCUMSTANCES, BE RESPONSIBLE OR LIABLE FOR THE LOSS OF DATA ON ANY COMPUTER OR INFORMATION STORAGE DEVICE.
UNDER NO CIRCUMSTANCES SHALL CyberSafeFamily ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY OTHER PARTY FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND (INCLUDING LOST REVENUES OR PROFITS OR LOSS OF BUSINESS) RESULTING FROM THIS AGREEMENT, OR THE FURNISHING, PERFORMANCE, INSTALLATION, OR USE OF THE SOFTWARE PRODUCT, WHETHER DUE TO A BREACH OF CONTRACT, BREACH OF WARRANTY, OR THE NEGLIGENCE OF CyberSafeFamily OR ANY OTHER PARTY, EVEN IF CyberSafeFamily IS ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT THAT THE APPLICABLE JURISDICTION LIMITS CyberSafeFamily’s ABILITY TO DISCLAIM ANY IMPLIED WARRANTIES, THIS DISCLAIMER SHALL BE EFFECTIVE TO THE MAXIMUM EXTENT PERMITTED.
Limitation of Remedies and Damages
Your remedy for a breach of this Agreement or any warranty included in this Agreement is the correction or replacement of the Software Product. Selection of whether to correct or replace shall be solely at the discretion of reserves the right to substitute a functionally equivalent copy of the Software Product as a replacement. Suppose _CyberSafeFamily cannot provide a replacement or substitute Software Product or corrections to the Software Product. In that case, your sole alternate remedy shall be a refund of the purchase price for the Software Product, exclusive of any costs for shipping and handling and for the months the software product has already been used. For example, if the purchased price is for three months subscription and after two months of use of the product if breach accurses, only a month’s subscription will be refunded.
Any claim must be made within the applicable warranty period. All warranties cover only defects arising under normal use and do not include malfunctions or failure resulting from misuse, abuse, neglect, alteration, problems with electrical power, acts of nature, unusual temperatures or humidity, improper installation, or damage determined by any reason caused by the licensee. All limited warranties on the Software Product are granted only to you and are non-transferable. You agree to indemnify and hold harmless from all claims, judgments, liabilities, expenses, or costs arising from your breach of this Agreement and/or acts or omissions.
Severability
If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are not permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.
